1. Who we are
Monica AI is the companion chat service published at monica-ai.net. In this policy "Monica AI", "we" and "us" mean the operator of that service, and "you" means any adult who visits the site or holds a Monica AI account. We act as the controller of the personal data described below.
2. Scope of this policy
This policy covers the Monica AI website, the chat interface, companion profiles, billing pages and any email we send you. It does not cover independent websites you reach by following a link away from Monica AI, or app stores and payment providers that publish their own notices.
3. Age requirement
Monica AI is intended solely for people aged 18 or older. We do not knowingly create accounts for minors and we do not knowingly collect their data. If we learn that an account belongs to someone under 18, we close it and erase the associated records. Guardians who believe a minor has used Monica AI should write to privacy@monica-ai.net.
4. Information you give us
When you register or manage a Monica AI account we may collect:
- an email address used for sign-in and account recovery;
- a display name or nickname you choose;
- the companion settings you configure, such as personality dials and interests;
- optional preferences like language and notification timing;
- the content of any message you send our support team.
Nothing beyond an email address is mandatory to start using Monica AI.
5. Conversation content
Messages exchanged with a Monica AI companion are stored so the conversation can continue where it left off. Conversation content is tied to your account, is not published anywhere, and is not sold, rented or shared with advertisers under any circumstances. You may clear an individual chat, a companion's memory, or your entire history at any time from account settings.
6. Information collected automatically
Like nearly every website, Monica AI records limited technical information when you connect: IP address, approximate region derived from it, browser type and version, operating system, screen size, referring page, and timestamps of requests. This information supports security, fraud prevention and basic performance monitoring.
7. Payment information
Monica AI does not see or store full card numbers. Payments are handled by regulated payment processors who return only a token, the last four digits, the card brand, the amount and the outcome of the transaction. We keep those limited details for billing history, refunds and tax records.
8. Cookies and similar technologies
We use strictly necessary cookies to keep you signed in and to protect forms against abuse. We use a small number of aggregate analytics cookies to understand which pages load slowly or fail. You can refuse non-essential cookies through the banner shown on your first visit or by clearing cookies in your browser; essential cookies cannot be disabled without breaking sign-in.
9. Why we process your data
We process personal data in order to create and secure your account, deliver companion replies, maintain conversation memory, process payments, answer support requests, detect abuse and fraud, meet legal obligations and improve the reliability of Monica AI. We do not process your data for behavioural advertising.
10. Legal bases for processing
Where data protection law requires a legal basis, we rely on: performance of a contract (running the service you signed up for), legitimate interests (security, abuse prevention, service improvement), consent (optional cookies and marketing email) and legal obligation (tax, accounting and lawful requests). You may withdraw consent at any time without affecting past processing.
11. Companion memory
Monica AI companions retain selected facts from your conversations so replies stay coherent over time. Memory entries are stored against your account, are visible to you, and can be edited or deleted individually. Deleting a memory entry removes it from future replies. Memory is never transferred between accounts.
12. Model improvement
By default, private conversation content is not used to train general-purpose models. Where a member explicitly submits a chat excerpt through the feedback tool, that excerpt may be reviewed by a small internal quality team and used to correct behaviour. Feedback submissions are stripped of account identifiers before review.
13. Service providers
We share the minimum necessary data with vetted providers who host our infrastructure, deliver transactional email, process payments, filter abuse and monitor uptime. Each provider is bound by contract to process data only on our instructions, apply appropriate security, and delete or return data at the end of the engagement.
14. International transfers
Monica AI operates on infrastructure located in several countries. Where personal data leaves your region, we rely on recognised transfer mechanisms such as standard contractual clauses, together with encryption in transit and at rest. You may request a summary of the safeguards in place.
15. How long we keep data
Account records are kept while your account is open. Conversation history is kept until you delete it or close your account. Billing records are kept for the period required by tax law, typically several years. Security logs are kept for a limited period, generally no longer than twelve months. After closure, remaining data is erased or irreversibly anonymised within thirty days, except where retention is legally required.
16. Security measures
We protect data using encrypted transport, encryption of stored conversation content, hashed credentials, strict internal access controls, audit logging, periodic penetration testing and separated production environments. No system is perfectly secure, but we treat member conversations as sensitive by default and design accordingly.
17. Your access and portability rights
You may ask what personal data Monica AI holds about you and receive a copy in a structured, machine-readable format. Requests are answered free of charge within thirty days. We may ask you to confirm control of the account email before releasing data.
18. Correction and deletion
You can correct your email, display name and companion settings directly in the account area. You can delete individual messages, whole conversations or the entire account. Account deletion is permanent: conversation history and companion memory cannot be recovered afterwards, and we will tell you this clearly before you confirm.
19. Objection and restriction
You may object to processing based on legitimate interests and ask us to restrict processing while a dispute is examined. Where an objection is upheld we stop the processing unless we have compelling grounds that override your interests, such as preventing fraud against other members.
20. Marketing preferences
Monica AI sends marketing email only where you have opted in. Every marketing message contains a one-click unsubscribe link that takes effect immediately. Transactional messages — password resets, receipts, security alerts and material changes to terms — are sent regardless, because they are necessary to operate your account.
21. Automated decision-making
Companion replies are generated automatically, which is the nature of the service. We do not use automated processing to make decisions producing legal effects about you. Automated abuse filters may temporarily restrict an account; you can request human review of any such restriction.
22. Data we never collect
Monica AI does not request identity documents, does not collect biometric data, does not access your contacts, camera roll, microphone or precise GPS location, and does not build advertising profiles about you. If any feature ever needs one of these, it will be optional and clearly explained before it is enabled.
23. Third-party links
Some pages may link to external resources. Once you leave monica-ai.net, the privacy practices of the destination apply and we have no control over them. We encourage you to read the notices of any site you visit from here.
24. Law enforcement requests
We disclose personal data to authorities only where we receive a valid, legally binding request from a competent body with jurisdiction over us, or where disclosure is necessary to prevent serious harm. We assess every request, reject overbroad demands, and notify the affected member unless legally prohibited from doing so.
25. Data breach handling
If a security incident affects your personal data and creates a meaningful risk to you, we will notify the competent supervisory authority within the statutory deadline and inform affected members directly, describing what happened, what data was involved and what steps we and you should take.
26. Regional rights
Members in the European Economic Area and the United Kingdom hold the rights described above under the GDPR and may complain to their national supervisory authority. Members in California may request disclosure of categories of data collected and shared, and may opt out of any sale of personal information — Monica AI does not sell personal information. Other regional rights are honoured where local law grants them.
27. Changes to this policy
We may update this policy as Monica AI evolves. The revision date at the top always reflects the current version. Where a change materially affects your rights, we will notify account holders by email or an in-service notice before it takes effect, and continued use afterwards indicates acceptance.
