These terms form the agreement between you and Monica AI. They cover what you may do here, what we promise, what we don't, and how either side can end the arrangement.
By opening monica-ai.net, creating an account or sending a message to a companion, you accept these terms in full. If you do not accept them, do not use Monica AI. These terms work together with the Monica AI Privacy Policy, which is incorporated here by reference.
"Monica AI", "we" and "us" mean the operator of the service published at monica-ai.net. "You" means the individual using the service. "Companion" means any fictional character available inside Monica AI. "Content" means text, images, audio and settings produced or submitted through the service. "Subscription" means any paid plan.
Monica AI is available only to individuals aged 18 or older who have full capacity to enter a contract. By using the service you confirm that you meet this requirement. We may request confirmation of age and may close any account we reasonably believe belongs to a minor, without refund of amounts already consumed.
Monica AI provides entertainment-oriented conversational companionship through fictional characters. The service includes chat, adjustable personality settings, conversation memory and, on paid plans, additional media features. Monica AI is not a dating platform, an introduction agency or a route to contact with real individuals.
Every companion in Monica AI is a fictional creation. Names, biographies, photographs and personalities are generated or invented for the service and do not represent real people, living or otherwise. Any resemblance to an actual person is unintended and coincidental. Statements made by a companion are generated text and must not be treated as fact.
Some features require an account. You agree to supply an accurate email address, to keep it current, and not to register on behalf of another person or under a false identity. We may refuse or cancel a registration at our discretion where the information supplied appears inaccurate or abusive.
You are responsible for keeping your credentials confidential and for all activity carried out through your account. Tell us at once if you suspect unauthorised access. We are not liable for losses arising from your failure to protect your credentials, though we will help you recover a compromised account.
Each person may hold one Monica AI account. Creating additional accounts to extend free allowances, evade a suspension or exploit promotions is a breach of these terms and may result in all connected accounts being closed.
Monica AI offers a free tier with a daily message allowance and limited features. The allowance, its limits and the features included may change at any time. The free tier is provided as-is, may be paused for maintenance, and carries no service commitment.
Paid plans are sold on a recurring basis. Unless cancelled before the end of the current period, a subscription renews automatically for a further period of the same length and the payment method on file is charged. We display the renewal date and amount in your account area before each renewal.
Prices are shown in US dollars unless stated otherwise and may exclude local taxes, which are added at checkout where applicable. We may change prices for future periods; existing subscribers receive notice before a change takes effect and may cancel instead of accepting it.
You may cancel a subscription at any time from your account settings. Cancellation stops the next renewal and leaves paid access active until the end of the period already paid for. No cancellation fee applies and no reason is required.
Amounts already charged are generally non-refundable, since access is granted immediately. We nonetheless review refund requests made within fourteen days of a charge and grant them where the service was materially unavailable, where a duplicate charge occurred, or where local consumer law requires it.
If a renewal payment fails, we may retry it for a short period and may suspend paid features until payment succeeds. Where payment cannot be collected, the subscription reverts to the free tier. Persistent chargebacks may lead to account closure.
You agree to use Monica AI lawfully and reasonably. You must not attempt to break, overload, reverse engineer, scrape or automate the service, must not resell access, and must not interfere with other members' use. Automated clients, bots and bulk data extraction are prohibited.
You must not submit or solicit content that involves minors in any sexual context, real-world violence, human trafficking, terrorism, weapons or drug trade, fraud, malware, or the personal data of another person shared without consent. Any attempt to steer a companion towards prohibited content results in immediate termination and, where required, a report to the authorities.
You keep ownership of what you write. You grant Monica AI a limited, non-exclusive, revocable licence to store, process and display your content solely to operate the service for you — to generate replies, maintain memory and provide support. This licence ends when you delete the content or close your account.
The Monica AI name, logo, interface, written copy, companion designs, imagery and underlying software are owned by us or our licensors and are protected by law. You receive a personal, non-transferable right to use the service. Nothing here transfers ownership, and copying or redistributing our material without permission is prohibited.
If you send suggestions, bug reports or ideas, you allow us to use them without restriction, credit or payment. This does not give us any right over your private conversations, which remain governed by the Privacy Policy.
We aim to keep Monica AI available continuously but do not guarantee uninterrupted operation. Maintenance, upgrades, provider outages and events outside our control may cause downtime. Where planned maintenance is likely to be noticeable, we try to announce it in advance.
Monica AI evolves. We may add, alter or withdraw companions, features and plans. Where a change materially reduces what a paid plan offers, we will notify affected subscribers and offer a pro-rata refund or a comparable alternative.
The service relies on third-party hosting, payment and delivery providers, and may link to external sites. We are not responsible for third-party terms, content or availability, and your dealings with them are your own.
Companion replies are generated for entertainment. They are not medical, psychological, legal, financial or safety advice and must not be relied upon as such. If you are in crisis or in danger, contact a qualified professional or your local emergency service immediately.
To the fullest extent permitted by law, Monica AI is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of generated content, or uninterrupted operation. Some jurisdictions do not allow such exclusions, in which case they apply only to the extent permitted.
To the fullest extent permitted by law, Monica AI is not liable for indirect, incidental, special or consequential loss, for lost profits, or for loss of data or goodwill. Our total aggregate liability arising from the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. Nothing limits liability that cannot lawfully be limited.
You agree to indemnify and hold Monica AI harmless against claims, damages, losses and reasonable legal costs arising from your breach of these terms, your misuse of the service, or your violation of any law or third-party right.
We may suspend or close an account that breaches these terms, that is used fraudulently, or where required by law. Serious breaches — in particular those in section 16 — result in immediate termination without refund. You may close your account at any time; sections that by their nature survive termination continue to apply.
Write to legal@monica-ai.net first. Most issues are resolved informally within a few days. If we cannot agree, both sides will attempt good-faith negotiation for thirty days before starting formal proceedings. Nothing prevents either party from seeking urgent injunctive relief.
These terms are governed by the laws applicable at the place of establishment of the Monica AI operator, without regard to conflict-of-law rules, and the courts of that place have jurisdiction. Consumers keep the benefit of any mandatory protections available in their country of residence.
If any provision is held unenforceable, the rest remains in force. Our failure to enforce a term is not a waiver of it. You may not assign these terms; we may assign them as part of a corporate transfer. These terms, with the Privacy Policy, are the entire agreement between us. We may amend them and will show the new revision date at the top; material amendments are notified in advance. Contact: legal@monica-ai.net.
